Welcome to MOSH Digital Services (“Company”, “we”, “our” or “us”). These Terms and Conditions (“Terms”) govern your use of our website https://moshdigitalservices.com and the services or educational programs we offer (“Services”). By accessing or using our website or Services you agree to be bound by these Terms. If you disagree with any part, please do not use our website or Services.
01Services
MOSH Digital Services offers branding, digital marketing, graphic design, SEO, website development, AI automation solutions and professional educational training programs. We reserve the right to modify or discontinue any service or course structure at our discretion, with or without notice.
02User & student responsibilities
- You agree to use our website, Services and training portals for lawful purposes only.
- You shall not misuse, resell, reverse-engineer or exploit any of our custom code, strategies, course videos or deliverables for unauthorised commercial use.
- You are responsible for providing accurate business data, prompt communication and the necessary credentials during any active service or training engagement.
03Payments, clear pricing & strict non-refund policy
- All service fees, project milestones and educational enrolments require 100% advance payment as per the invoiced amount, unless a custom payment schedule is explicitly issued by us.
- Our officially issued invoice stands as the final binding commercial agreement. By paying the invoice you fully acknowledge and accept these Terms. No separate external contract or verbal commitment shall override them.
- We maintain a strict NO-REFUND, NO-CANCELLATION and NO-TRANSFER policy once payment is processed, regardless of client dissatisfaction, business closure or change of mind.
- Fees paid for a specific service or training path cannot be substituted for another service, nor transferred to any third party or another student.
- For detailed clauses on exceptions and evaluation criteria, please refer to our Refund and Returns Policy, which is fully incorporated into these Terms (see Section 4 below).
04Refund & cancellation policy
All payments made to MOSH Digital Services for services, subscriptions, annual plans, training programs or educational enrolments are strictly non-refundable and non-cancellable once processed.
- Requests for refunds or cancellations based on change of mind, business closure, unmet expectations that fall outside of our written scope, or dissatisfaction with outcomes that depend on external factors will not be entertained.
- Fees are tied to the specific service or training path purchased and cannot be transferred to another service, another student or a third party.
- In the rare case a service cannot be delivered by us for reasons entirely on our side, we may — at our sole discretion — offer service credits of equivalent value to be utilised within a defined period. No cash refund shall be issued.
- Chargebacks or payment disputes filed without first attempting resolution with our team will be contested and may result in immediate termination of all active services and access.
05Special annual & continuous maintenance plans
All annual plans and ongoing digital maintenance structures are offered at heavily discounted rates exclusively for clients who commit to the full 12-month service period.
- This discounted pricing is strictly conditional upon completing the entire annual term.
- Once the annual plan commences, no refunds or cancellations will be accommodated.
- In exceptional cases, if a mid-term termination is reviewed at our sole discretion, the utilised period will be completely recalculated at our standard non-discounted monthly rate (e.g. ₹10,000/month or as applicable). The discounted annual equivalent will not be divided on a pro-rata basis, and any potential remaining balance, if approved, will be minimal and entirely subject to our final evaluation.
06Service tenure, utilisation & client inaction
All digital deliverables — content creation, SEO optimisation, website design, AI workflow management, advertising support and technical updates — will be provided strictly within the contracted service period.
- Client input: Clients must provide all necessary assets, copy, approvals and system access within the service tenure. If a client fails to provide required input on time, MOSH Digital Services reserves the right to proceed with the available information and will not be held liable for any resulting delays or performance impact.
- No extensions for unused tenure: If a client fails to utilise our services or attend scheduled interactive sessions during the contracted period due to non-responsiveness, lack of engagement or internal business delays, any unused portion of the tenure will instantly expire. Unused hours or tasks will not be extended, rolled over or carried forward beyond the original end date. No refunds will be provided for unused contract periods.
- Service completion: All obligations are considered fully delivered and completed on the final calendar date of the contracted period. Any subsequent tweaks or extensions will require a completely fresh invoice.
07Intellectual property & course content usage
- All custom graphics, software scripts, AI automation setups, optimisation blueprints and web frameworks created by us remain the exclusive intellectual property of MOSH Digital Services until the respective invoice is cleared in full.
- Course access & ownership: All educational materials — including live session recordings, uploaded video modules, documents, scripts and shared resources — are the intellectual property of MOSH Digital Services.
- Students are granted a limited, personal, non-transferable and non-exclusive licence to use these materials solely for private educational purposes. Any unauthorised reproduction, sharing of portal login details, public broadcasting, distribution or commercial exploitation of our training content is strictly prohibited and will result in immediate legal action and a permanent ban without notice.
08Course delivery, live sessions & student conduct
- Training format: Our educational programs are delivered via comprehensive models including self-paced pre-recorded paths, live streaming meeting platforms (such as Zoom or Google Meet) and digital workshops. Students must maintain the required hardware, software and internet connectivity to participate.
- Code of conduct: Students and clients are required to communicate respectfully with instructors, team members and fellow participants. Abusive language, disruptive behaviour, harassment or unethical outreach will result in immediate termination of access or services without any refund liability. Outstanding dues must still be cleared.
09Client materials & third-party tools
- You warrant that you own or possess legal usage rights for all materials (logos, graphics, fonts, imagery, copy) supplied to us. We are not liable for any third-party copyright infringement claims arising from assets you provide.
- We use various premium third-party APIs, platforms, hosting configurations and tools (such as Elementor, n8n, hosting frameworks and others). We are not responsible for sudden policy changes, outages or technical limitations imposed by those external providers.
10Disclaimer of guarantees & limitation of liability
- No outcome guarantees: While we deploy high-performance strategies and aim for meaningful digital transformation, MOSH Digital Services does not guarantee specific monetary results, exact search-engine rankings or fixed financial returns from our services or courses.
- Limitation of liability: To the maximum extent permitted by applicable law, MOSH Digital Services shall not be held liable for any indirect, incidental, special or consequential damages — including loss of business profits, data corruption or server downtime — arising out of the use of, or inability to use, our website, services or courses.
11Governing law & dispute resolution
- Jurisdiction: These Terms are governed by and construed in accordance with the laws of India.
- Dispute resolution: Any legal questions, operational disputes or arguments related to our Services, invoices or courses will first be targeted for resolution through mutual, friendly discussion. If a settlement cannot be reached, all unresolved matters will be handled exclusively within the jurisdiction of the courts in Vadodara, Gujarat, India, and that decision shall be final and binding.
